Community Guardian Program
JASA assumes the legal role of community guardian for adults (18 and over) who have been judged legally incapacitated by the courts and require a legal guardian. Through assessment, comprehensive service planning, regular visits, ongoing support, and regular reports to the courts, JASA ensures that the needs of these individuals are met. Guardianship responsibilities can encompass a wide range of duties. Based on court decision this can include assistance with aspects of daily living and advocacy with medical and social service providers.
Responsibilities Include:
● Financial Interview for Medicaid application process
● Having client or family sign authorization and order all documents related to application
● Order all documents and follow up with financial institutions
● File Medicaid application/conversions
● Follow up with caseworker
● File fair hearing and attend if necessary
● Budget corrections if necessary
● Yearly Medicaid recertification
● Enrollments in mandatory MLTC plans
● Educate families about income payments and requesting signatures
● Discuss with Private Patients finance options
● Guardianship petition when necessary
● HMO disenrollment's, MLTC enrollments
● Prepare any requests from comprehensive related to establishment and continuation of payer sources
● Experience necessary, experience in long term care preferred
Job Description:
● Coordinate with families and patients to obtain documents regarding patient financial history with the purpose of applying for Nursing Home Medicaid benefits. This includes drafting letters and following up with banks, pension companies, Social Security, the IRS, the County Clerk, and any other institution or person that would be able to provide the information necessary to obtain appropriate benefits.
● Screen patients being admitted for a LTC stay and assess whether they will meet the financial criteria for Medicaid eligibility.
● Advocate on behalf of patients with caseworkers at their respective Department of Social Services.
● Coordinate with family and facility attorneys/ consultants regarding pending Medicaid applications and conversions.
● Determine estimated NAMI and ensure income is being turned over to the facility based on Medicaid guidelines (for pending cases) or as determined by DSS (for approved cases). This includes coordinating with Social Security, pensions, and I-TC insurance companies to have income redirected to the facility when appropriate.
● Coordinate with MLTCs, MMCs, and with DSS regarding Medicaid conversions and recertification to ensure all Medicaid and MLTC patients have appropriate coverage.
● Determine the appropriate Medicaid Pickup Date based on other insurances that cover the patient and coordinate with the facility interdisciplinary team to ensure therapists and discharge social workers are informed about the resident's financial circumstances as they relate to their needs in the facility.
● A basic knowledge of Medicaid law, including but not limited to income and resource guidelines.
● Citizenship and residency requirements.
● Allowable and non-allowable asset transfers.
● Familiarity with guardian-ships and Power of Attorney laws as they pertain to the Medicaid application process.
● An understanding of the forms and notices used by HRA and the other Departments of Social Services in NY State.
● The ability to invoice and collect money.
● A basic understanding of payer sources used in the SNF industry.
● Basic computer skills including the use of Microsoft Outlook, Word, and Excel.
● The ability to interact with families, fellow employees, and 3rd parties in a courteous and professional manner.
An undergraduate degree in business, social work, social or human services, or related field. Year to year experience may be considered in lieu of the degree.
